Terms of Service

1. Acceptance of Terms & Age Requirements

By downloading, installing, or using MindCraft Studio, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the application.

Age Requirement: You must be at least 17 years of age to use MindCraft Studio, as the application allows for the generation of content using artificial intelligence. If you are under 17, you are not permitted to use this application.

2. License & Software Use

MindCraft Studio grants you a personal, non-exclusive, non-transferable license to use the software on your Mac devices. This license includes access to our locally-hosted models and our integrated cloud generation services where available.

Open Source Models: MindCraft Studio utilizes various open-source technologies, such as Stab, FLUX and MLX. These models are used in accordance with their respective licenses. You agree to abide by the use restrictions set forth in these licenses.

3. User Accounts

To access certain features, including cloud generation and synchronization, you may be required to register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Guest Login: If you use our anonymous "Guest Login" feature, your account and credits are bound to your specific device hardware. Please be aware that clearing application data or losing access to your hardware may result in the permanent loss of access to your Guest account.

4. Cloud Services & Commercial Rights

Commercial Use: You retain full ownership and commercial usage rights for all images generated through our cloud-based services. For images generated using local models (running on your own hardware), commercial usage rights are subject to the specific licenses of those models (e.g., various open-source versions of Stable Diffusion or FLUX). You are responsible for ensuring that your intended use of locally-generated content complies with the respective model licenses.

Cloud Infrastructure: Usage of cloud-based models is subject to the acceptable use policies of our third-party infrastructure partners. Any attempt to generate content that violates these policies or our safety guidelines will be automatically rejected.

Data Disposal: As detailed in our Privacy Policy, your prompts and reference images are purged from our cloud environment after the generation process is complete.

5. Credits & Billing

Certain cloud-based features consume usage credits. Credits are non-transferable and have no cash value.

Safety Rejections: Credits consumed by requests that are rejected due to violations of our Content Safety guidelines (e.g., attempting to generate prohibited NSFW content) are non-refundable.

Refund Policy: All purchases of credits or subscriptions are final and non-refundable, except where required by law.

6. User Responsibility & Content Safety

Ownership: You retain ownership rights to the images you generate. For cloud-generated images, these rights include full commercial use. For locally-generated images, rights are subject to the licenses of the specific generative models you choose to install and use on your local hardware.

Prohibited Content & NSFW Rejection: You agree not to use MindCraft Studio to generate content that is illegal, promotes violence, or depicts sexually explicit/NSFW material. Cloud-based services employ automated safety filters; any attempts to generate prohibited content will be automatically rejected.

  • Illegal content under applicable law.
  • Promotion of violence or hatred.
  • NSFW, sexually explicit, or pornographic content.
  • Violation of intellectual property rights.

7. Software Updates

We may periodically release updates to MindCraft Studio to improve performance or add features. Updates are provided at our discretion.

8. Limitation of Liability

MindCraft Studio is provided "as is" without warranty of any kind. To the maximum extent permitted by law, MindCraft Studio shall not be liable for any indirect, incidental, or consequential damages arising out of the use of the software or cloud services.

9. Governing Law

These terms are governed by the laws of our operating jurisdiction, without regard to conflict of law principles.
